The content and structure of these Terms, as well as the on-line booking service provided through the Platform, are owned, managed and maintained by TransferNTour Ltd. and are provided for your personal and non-commercial use only subject to the terms set out below. Our business relationship with Service Providers is governed by a separate agreement. Each Service Provider is obliged to act in a professional manner to TransferNTour Ltd when providing its service through TransferNTour. Please note that Service Providers may have and/or require (in addition to terms and policies provided on our Platform) their own terms and internal rules of use, access, and service consumption, which may include specific disclaimers and limitations of liability.
TransferNTourLtd. (hereinafter referred to as “TransferNTour” or “we”, “us”) is a limited liability company incorporated under the laws of the Republic of Bulgaria, registered with the Bulgarian Commercial Register under UIC 205699136 and having its headquarters’ address at 12 Iliyantsi blvd.1220 Sofia, Bulgaria. TransferNTour Ltd. is a company registered under the Value Added Tax Act, and having VAT ?: BG 205699136;
“TransferNTour Platform” (hereinafter referred to as “the Platform”) is the (mobile) website and application for mobile phones, tablets, or similar devices (“Devices”) created and administrated by TransferNTour Ltd. The Platform provides to the Users free information as well as the possibility to make an online reservation and to purchase a various range of travel services provided by Service Providers with individually defined price, such as: shuttle transfers; private transfers with driver; private, group or shared transfers by helicopters and air jets; private and organised sightseeing tours, wine&tasting tours, long and short cruise and sailing services etc. (hereinafter referred to as "the Services");
“Service Provider” is the professional/licensed and accredited provider of: private transportation services (e.g. car rentals with chauffeur, shuttle rides);private transfers by helicopters and jets;sightseeing tours and attractions (e.g. (theme) parks, museums, private tours, wine & food tasting tours etc.); weddings and seminars; long and short cruise and sailing services, etc. and any other travel related product or service, as from time to time available for Tour/Transfer/Cruise Reservation on the Platform.
“Booking”, “Reservation” is the order, purchase, payment or reservation of a Service and /or similar travel-related product offered on the Platform.
“User”, ”Customer”, “You” is an individual visitor and/or consumer of the Services offered by the Platform.
TransferNTour aims to enable travellers to see the world, by offering the best transfer and tour service to greatest touristic destinations and attractions to visit in the most convenient mobile way, by hiring passenger vehicles with driver, which are operated by Service Providers (all accredited/licensed by local, national, regional bodies of Tourist Transportation Authorities).
Through the Platform TransferNTour provides an online interaction through which Service Providers can advertise, sell, promote and/or offer their products and service for order, purchase, reservation, hire, and through which Users of the Platform are able to search, find, compare, and make an order, reservation, purchase or payment of any services independently and in combination.
By using the Service or making a Booking you agree to engage in a legally binding contractual relationship with the Service Provider, with which you make a booking or purchase a product or service on offer. From the moment your Booking is made, we act only as an intermediary between you and the Tour/Transfer/Cruise Provider by submitting the relevant details of your Booking to the relevant Service Provider and sending you a confirmation email on behalf of the Service Provider.
It is expressly agreed and stated, that the Company in no way mediates for the execution of a transport project of things or passengers. Its services to its contracting partners relate exclusively to their promotion and advertising through its electronic application in order for the information of these companies to be communicated to the users of the application. For this reason, any emerging contracts or services of the Partnership Contracting Partners with the users of the application directly and explicitly concern themselves (partner - user) and the Company has no absolute liability or accountable relationship, it just communicates in-formation from both sides. Any remuneration of the Company by its contracting partners is expressly stated that it concerns exclusively its sole remuneration for the promotion and advertising of the services of its partners, the disclosure of information and this remuneration may be defined either on a flat rate, subscription basis or lump sum, either as a percentage of the partial or total turnover of the partners. To this end, the Company is only entitled to keep a record of the transactions or information of the partners, otherwise the latter are obliged to pro-vide it with information about their transactions with their customers. In any case, the Company does not receive a Pricing for the execution of a post-loading project or for the execution of a transaction and clearly does not invoice itself the services provided to the users, but only invoiced the service providers the promotional fees calculated, as per Appendix I in the partnership agreement.
TransferNTour, does not (re)sell, rent out, offer any (tour/transfer/cruise) service or perform and finally does not deliver the relevant service with its own transport vehicles and/or other means, such as: cruise ships, limousines, buses, mini lux Vans, Helicopters or LearJets etc.
The information which we disclose for the Services on our Platform is based on the information provided to us by the Service Providers. The Service Providers that sell and promote their services on the Platform have access to our systems and Extranet, through which they are fully responsible for updating their rates, fees, prices, availability, policies, and conditions as well as other significant information displayed on our Platform. Although we do our best of our ability, skill and care to achieve the high quality of the services we offer, we cannot verify if, and cannot guarantee that, all available information is accurate, complete or correct, nor can we be held responsible for any errors (whether they are obvious or typographical errors),any interruptions (whether due to any temporary/partial breakdown, repair, upgrade or technical support of our Platform or otherwise), misleading, untrue or inaccurate information. Each Service Provider is responsible for the accuracy, completeness, and correctness of the information displayed on our Platform.
Our Service advertisement and booking system, is made available for personal and non-commercial use only. Therefore, you are prohibited in re-selling, deep linking, using, copying, monitoring, displaying, downloading or reproducing any content or information, software, reservations, products or services available on our Platform for any commercial or competitive activity or purpose.
TransferNTour’s mission is to bring invaluable experience to travellers worldwide and is committed to delivering a well-linked transport/transfer, tour, cruise and other related services for leisure, business, and other purposes in local, national, and international range, operated only by licensed and well-accredited transfer, tour and cruise provides, all regulated by local, national, and international authorities of transport and tour operations. To become a User of our Platform, you need to download our Mobile Application “TransferNTour” to your smartphone or tablet mobile device, from either App Store for iOS devices, or Google Play for Android ones. You can create an account with your mobile phone number or login with your social media accounts (Google, Facebook, and Twitter). Shortly we will send to your mobile phone number a verification code that you must type and submit. After that, you must set your password and provide us with some basic information (name, email id, and address, as well as a person of contact, in case of an emergency, only if you wish to).
Upon making registration and creating an account on the Platform, the User receives free access to information regarding the Services offered on the Platform.
If you are a professional provider of the services offered on our Platform, you can register on our website https://www.transferntour.com and become our affiliate partner, and service provider, and enjoy the benefits and fare deal solution our platform model is offering.
TransferNTour allows for the Platform User’s account data to be password protected. As general best practice on the Internet, it is recommended that Platform Users do not use trivial passwords. Passwords should contain a combination of letters and numbers, and be kept securely and changed periodically. Users are responsible for all activity on their account and for keeping their password safe and secure, as well as they are totally responsible if they personally choose to give passwords or any operational rights to third parties.
The Users should take all necessary steps to ensure that their password is kept confidential and secure and should inform TransferNTour immediately, if they have any reason to believe that their password has become known to anyone else, or if their password is being, or is likely to be used in an unauthorized manner by anyone they are not aware of.
The prices of the services offered on our Platform are highly competitive and are made exclusively by the Service Providers themselves without interfering in the prices and offers they offer us. We show you a list of different offers to choose from. The order in which Service Providers appear on our Platform depends on the criteria you have set for the service you are looking for. Once you set the criteria for the service (e.g. price, vehicle, duration, etc.), the first 10 offers matching your search will appear on your mobile device. You can also look at the next 10 offers and choose to book the one you like the most.
All estimated and/or fixed prices for the services include VAT and all other taxes and fees unless otherwise stated on our Platform or in the confirmation email (message).
Applicable fees and taxes may be charged by the Service Provider in the event of a no-show or cancellation. Please, always review these policies prior to booking. In case you are not sure of the time and date of the service you want to book, you are strongly advised not to make any purchases, because different cancellation policies may apply by Service Providers, such as in aviation, cruise, transfer and tour cancellation policies and so on, that are beyond the control and liability of TransferNTour Ltd.Other services that require much more detailed resolution, such as in cruises and aviation transfers (Lear-jets, helicopters), for example air transfers and long cruises that require airline tickets and/or hotel bookings, then the actual cancellation policy in effect is the one of the Service Provider’s, who is liable in handling the claim. However, we charge Promotion Reward Fee tothe Service Provider upon the cancellation value, prior to VAT charges.
It is possible for cheaper than normal rates to be available on our Platform for a specific service. Bear in mind that, these rates made available by the Service Providers, may carry special restrictions and conditions, for example, non-cancellable and non-refundable. In this case, the Platform User is responsible for checking the relevant service and reservation terms, conditions and details applicable, thoroughly prior to booking and reserving the service.
Each Service Provider places its own offer available directly to our platform, so the User can reserve and complete the tour, transfer or cruise. All the procedure is completed through the TransferNTour platform.
We are proud to offer a free of charge service and solution for our Users because, unlike many other companies, we do not charge Users for our Services and we do not add any additional handling or reservation fees to the price of the service.
The Platform User will pay to us the amount as indicated in the relevant booking price, and we will only charge a Pricing for our services the Service provider not the Customer/USER of the Platform.
We are proud to offer a free of charge service and solution for our Users because, unlike many other companies, we do not charge Users for our Services and we do not add any additional handling or reservation fees to the price of the service.
The Platform User will pay to us the amount as indicated in the relevant booking price, and we will only charge a Promotion Reward Fee for our services the Service provider not the Customer/USER of the Platform.
TransferNTour charges the Service Provider with a Promotion Reward Fee that is a percentage of the service price after User has consummated the service (e.g. after the user has been transferred from the airport/port to the hotel or by the completion of a tour with the vehicle or tour guide). Despite the practice of our competitors to charge a Promotion Reward Fee on the total price (including VAT) TransferNTour has chosen to calculate a Promotion Reward Fee only on the value of the product/ service prior to VAT charges. We have invented the technology to help us all resolve issues as such through our dynamic dashboard resolution, of its IP rights are totally reserved by TransferNTour Ltd, &TransferNTour SA.
Service Providers can lower their Promotion Reward Fees by:
The payment of services (except the services that allow cash payment) is made through our Platform in accordance with the applicable payment policy of the Partner for the relevant booking and disclosed on the Platform. We facilitate the payment of the services by offering you three payment modes: “wallet”, “credit/debit card” and “cash” (if applicable).
“Wallet”: You can select to pay via “wallet” if you have deposited money in it. The money left after the payment of the service will be refunded on your debit/credit card or may remain in your wallet and be used by you to pay for future services.
“Credit/debit card”: Payment of the service price is processed from your credit/debit card to the special account of the App (Cashflows Merchant account) through online payment gateway (JudoPay API). The credit card details that Users submit on our Platform are sent securely to the gateway server through a secure background process. Sensitive customer data is stored in data centres conforming to the highest security standards. The gateway JudoPay safeguards your payments against threats.
“Cash”: Cash payment only possible if applicable to the service or the Service Provider accepts such payment. Usually, drivers accept cash payment for their transport service.
*For higher-priced services (such as cruises, or aviation transfers) payment can also be made by bank transfer to our Merchant account through TransferWise Bench Payment system (if applicable) or standard bank transfer, and we will distribute the money to the service provider within 12 hours less, managed to be sent automatically by our system every 6 hours. In case the Service Provider has or is willing to create an account with “Cashflows”, then transfers only cost __ per transfer and much faster time in transferring funds can be achieved (e.g. 10min after booking payment).
We use a multiple-choices TransferWise Bench Payment System, which helps us to clear all accounts in one go either by depositing the money directly to your account or into your TransferWise Account if you have one. It is such a great tool and a much more economical solution than the ordinary banking system can offer that we are glad to work with them and make such an economical, secure and fast money transfer and invoice payments for our Service Providers and us.
Any payment facilitated by us for and on behalf of and transferred to the Service Provider, will in each case constitute a payment of or part of the booking price by you of the relevant service in the final declaration of payment of such (partial) due and payable price and you cannot reclaim such paid money.
Please note that for certain (non-refundable) prices or special offers, that Service Providers may require prepayment and your credit/debit card may be pre-authorized or charged (at times not eligible for a refund) at the time of making on your reservation. Please check the booking details of your selected service thoroughly for such conditions before making your reservation. You will not hold TransferNTour responsible for any (authorized, unauthorized or wrong) charge the Service Provider and not claim any amount for any valid or authorized charge by the Service Provider (including for pre-paid rates, no-show and chargeable cancellation) of your credit card.
By making a tour, transfer or cruise booking with a relevant Service Provider through our Platform, you accept and agree to the relevant cancellation and no-show policy of that Service Provider, and to any additional delivery terms and conditions of the Service Provider of your choice, that may apply to your tour, transfer or cruise. The general cancellation and no-show policy of each service is made available on our Platform on the Service Provider information pages, during the booking procedure, and in the confirmation email.
8.1. General Cancellation Policy for Transfers (Ride)
If you want to cancel after you have booked a transfer and have selected a driver, cancellation fees may apply depending on the time boundaries you decide to cancel, for compensating the allocated drivers for the time and effort they put into reaching your pick up location, and meeting your request needs in fast and professional manner.
For the “Ride Now” service: you can cancel the ride free of charge within 3 min after the booking. If you cancel the ride any time between 3 to 6 min after the booking confirmation you will be charged 10% of the ride cost. For cancellations after the period of 6 to 10 min and prior to the car arrives, you will be charged with 20% of the ride cost. For cancellations after 10 mins of booking you will be charged 30%. In cases of ‘’no-show,‘’ you will be charged 100% of the ride cost since the drivers have lost a considerable amount of time and effort in reaching and waiting at your pick up location.
“Ride now” requests must be made only when you are ready for a ride, and you are close enough to the pick-up location. This ensures fast pick-up for passengers, but also saves up troubles and time of the drivers and yourselves from cancellation expenses.
For the “Ride Later” service: free of charge cancellation shall apply only if you cancel the ride at least 90 mins prior to departure time. If you cancel the ride in less than 90 mins, 30% of the ride cost will be charged since the drivers have rejected other reservations in order to satisfy your request.
If you arrive at the pickup location 5 minutes after the arrival time of the driver, the driver may cancel the route and a cancellation fee will be applied, or your ride cost will be recalculated for the extra waiting time.
8.2. General Cancellation Policy for Tours and Activities
In most cases, you can cancel your booking for a full refund up to 24 hours before your tour or activity. However, please check the “Terms and Conditions” section of your service providers for the detailed cancellation and no-show policy for the booked tour or activity. In case of cancellation after the 24 hours limitations, the tour provider’s cancellation policies shall apply.
8.3. General Cancellation Policy for Cruises
We comply with the cancellation policy of each Cruise line provider due to uncontrollable costs that this service has, which we are not able to handle and or control ourselves. This may include, various semi or non-refundable fees, such as air tickets and hotel bookings, in the departure/arrival location point for cruises or special airport fees that are subject to aviation regulated authorities which cannot be refunded for liar and helicopter private transfers.
However, if you cancel 60 days prior to departure (departure time counts, for example, if you have a flight to reach the departure location of the cruise ship) you will be charged only the booking deposits. After that time scale above cancellation policy and charges of the service provider apply and please see them prior to your decision in making the booking.
We recommend that you read the cancellation, (pre)payment and no-show policy of the Service provider, carefully prior to making your booking.
Please note that certain rates, fees or special offers are not eligible for cancellation, refund or change. Applicable taxes may still be charged by the Service Provider in the event of a no-show or charged cancellation. Please check the (reservation) details of your activity or service of choice thoroughly for any such conditions prior to making your Booking. Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are for your own risk and account and you shall not be entitled to any refund of any (non-refundable) prepaid amount unless the Service Provider agrees or allows otherwise under its (pre)payment and cancellation policy.
If you wish to review, adjust or cancel your Tour/Transfer/Cruise Booking, please revert to the confirmation email and follow the instructions therein. Please note that you may be charged for your cancellation in accordance with the Service Provider’s cancellation, (pre)payment and no-show policy or not be entitled to any repayment of any (pre)paid amount. We recommend that you read the cancellation, (pre)payment and no-show policy of the Service Provider, carefully prior to making your booking and remember to make further payments on time as may be required for the relevant reservation.
The communication and correspondence between you and the Service Providers will be done through our Platform. Telephone calls between you and the relevant Service Provider (e.g., between you and the driver) will be made through interactive design connection (InApp Calling). TransferNTour disclaims any liability or responsibility for any communication by or with the Service Provider through its platform. You cannot derive any rights from any request to, or communication with the Service Provider or (any form of) acknowledgment of receipt of any communication or request. TransferNTour, cannot guarantee that any request or communication will be (duly and timely) received/read by, complied with, executed or accepted by the Service Provider.
In order to complete correctly and confirm your Booking, you have to use your correct email address and (mobile) phone number. We are not responsible and we are not obliged to verify any wrong or misspelled email addresses or phone numbers or credit card numbers.
Claims or complaints against TransferNTour or in respect of the provided service must be promptly submitted but in any case within 30 days after the scheduled day of consummation of the product or service. Any claim or complaint that is submitted after the 30 days period, may be rejected and the claimant shall lose its right to any compensation (for costs and damages).
Users, who have used the services through our Smartphone application may comment and evaluate their experience in using the service provided and the affiliate companies or Service Providers. The service user review may be (a) uploaded onto the relevant Service Provider’s information page on our Platform for the sole purpose of informing future customers of your opinion of the service level and quality of the Service Provider, and (b) fully or partly used and placed by TransferNTour at its sole discretion for marketing, promotion or improvement of our service on our Platform or such social media platforms, newsletters, special promotions, apps or other channels owned, hosted, used or controlled by TransferNTour and our business partners. In order to be able to offer and keep up-to-date reviews, the reviews can be submitted only within a limited time (28 days) after the use of the service, and each review will be available only for a period of 24 months after posting.
We reserve the right to correct, refuse or remove reviews that violate our review policy. TransferNTour does not compensate or reward Users in any way for completing a review. The service user review form should be considered as a survey and does not include any further commercial offers, invitations or incentives whatsoever.
TransferNTour shall use its best efforts to monitor and remove reviews that include obscenities or the mention of obscene words, personal name or reference to stolen goods. TransferNTour will not accept and/or tolerate reviews which include:
Due to a large amount of these reviews and comments, we are sorry and please accept our apologies in advance, in case we have not realized the publication of such biased and discriminatory comments and would be grateful if you would draw our attention to take immediate action and remove it immediately.
TransferNTour acts only as an intermediary in making arrangements Services featured on this Platform and does not assume any responsibility for the Services provided by the Service Providers and make no representations or warranties (express or implied) as to the suitability or quality of Services. TransferNTour is not a (re)seller of the services. You acknowledge and agree that the relevant Service Provider is solely responsible and assumes all responsibility and liability in respect of the service (including any warranties and representations made by the Service Provider). Complaints or claims in respect of the service (including related to the offered price, policy or specific requests made by Users) are to be dealt with by the Service Provider. TransferNTour is not responsible for and disclaims any liability in respect of such complaints, claims, and liabilities.
TransferNTour shall not be in breach of these Terms, or liable to you due to our failure, delay or inability to fulfil any performance of any obligation under these Terms by reason of, including but not limited to any natural disaster like, any fire, earthquake, flood, substantial snowstorm, epidemic, explosion, strikes, riot, civil disturbance, war, any failure or delay of any transportation, power or communications system, shipping and aviation regulated liabilities, non-performance by suppliers or subcontractors or any similar events which are beyond our control.
We act only as an intermediary and we are not liable for any force majeure, personal injury, death, illness, property damage or other loss or expense of any nature arising directly or indirectly arising out of any actions taken by a transportation company, travel agent, guides, cruise liner or any other Service Provider whose products or service are (directly or indirectly) made available or offered on or through our Platform.
Whether or not we have facilitated the payment of the service price, you acknowledge and agree that the Service Provider is responsible at all times for the collection, withholding, and payment of applicable due taxes to the total amount to the relevant tax authorities and TransferNTour is not responsible for that.
Subject to the limitations set out in these terms and to the extent permitted by applicable law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the reservation confirmation email.
This Platform is provided on an ‘as is’ and ‘as available’ basis. We do not accept any liability in respect of your inability to access or use this Platform at any time or for any interruption in that access or use, or for any failure to complete any transaction.
TransferNTour takes due care and is responsible for protecting the User’s information that has become known regarding the use of the Platform by the User.
TransferNTour collects, processes and stores the personal data provided by the Users, strictly observing the provisions of the European General Data Protection Regulation 2016/679 of 27 April 2016 and the Personal Data Protection act.
?he content of the Platform, how the information is arranged and structured, all the materials, databases and other resources posted on the Platform are the exclusive property of TransferNTour or of the designated person to whom the right to use TransferNTour has been delegated. The above described is protected by the Copyright and Related Rights Act. The User of the Platform acknowledge not to send or transfer in any way the Platform and/or the content of the website/application to any other computer, server, web page, or other public device and won’t reproduce, modify, deletes, publishes, distributes, discloses, and uses in any other way the Platform’s information, content, business model, design or any company resources for purposes other than those specified in this terms.
Any publication, reproduction, and sale of information and photos from the Platform, in any form without the written consent of TransferNTour is forbidden and constitutes as a material infringement of our intellectual property rights and copyrights. The User of the Platform is responsible for all damages resulting from violating this provision.
The software required for our services or available at or used by our Platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our Platform are the property of TransferNTour Ltd.
